Danish individual given deferred sentence for sharing nude film scenes on Reddit
A Danish man has been convicted of uploading sexually explicit segments from protected films and television shows on the social media platform Reddit.
According to a police document reviewed by BBC News, the anonymous man shared 347 clips of nude content in a subreddit he managed, which were then viewed 4.2 million-plus times.
The country's authorities confirm he has been given a seven-month deferred jail term for violating copyright laws.
Legal analysts say the man was charged under a rarely-used clause in Denmark's copyright law, with the judge ruling that by taking the scenes out of their original context, the man had harmed the artists' "ethical entitlements".
He has also been found guilty of sharing more than 25 TB of protected digital content.
From spring 2022 to mid-2023, the man using the alias "KlammereFyr" on Reddit uploaded adult scenes including over 100 female performers.
He shared them in the forum he was a moderator of.
Per the Danish copyright protection group the Rights Alliance, his online community had more than 6,000 members and users were prompted to request excerpts of particular performers.
In 2023, advocates filed the incident to the police on behalf of the impacted actors, filmmakers and producers, which led to the forum being shut down.
Andrea Vagn Jensen, among the performers whose nude scenes were circulated in the community, told local media at the time she felt there was a distinction between appearing naked in a film and appearing on Reddit.
The actress said the posts amounted to "exploitation".
'A significant message'
The defendant was arrested in September 2024 and pleaded guilty to the allegations last month.
In a statement following the ruling, the head of the Rights Alliance Maria Fredenslund said the decision sent an "important" signal "that infringements of creators' rights have consequences".
The ruling is considered unprecedented in Denmark for its application of the "ethical protections" clause of the national copyright law, which specifies an artist's creation cannot be utilized in a manner which infringes upon their reputation.
Copyright law specialist a legal scholar informed the media the legal matter was "unusual" for its emphasis on the harm to the integrity of an artist, rather than to them financially.
The extent to which the case could influence nations abroad is unclear.
But she added there may be "an increasing number of these actions" in the coming years with the advancement of AI, where "the sanctity of an individual's creative output might be tempered with much more easily".
